California voters will decide this November whether personal use possession of marijuana should be legalized. Proponents of the legalization argue that taxing marijuana sales will help with the state's budget problems while opponents believe that legalization will lead to more impaired driving and that marijuana is a "gateway drug".

Not necessarily - look to your state laws or court opinions about police searches and probable cause. Not every teen that carries a lighter smokes. In some jurisdictions the officer needs more than a lighter to support probable cause that a minor has tobacco or marijuana in his/her possession.

Dear Monmon: Askthejudge.info does not provide legal advice and we cannot tell you what you should do. You could always speak with a local defense attorney before your first court date, but you may also want to wait until after court so that you have a better idea what to expect and whether you feel it's necessary to hire an attorney. The consequences you face depend on the laws of the province you live in. The court process will most likely be explained to you at your first court date. In the U.S., a similar shoplifting offense for someone with no criminal record could result in a diversion program. This means that after community service hours are completed, a fine/restitution is paid and a class or counseling session is completed, the case would be closed. Again in the U.S., a probation period may also be imposed, but jail is not normally imposed for the first offense; however, every state/province has its own laws and every court/jurisdiction has its own sentencing policies. Be sure to show up at your first court date and you will find out then what you can expect as the case moves forward towards a resolution. Good luck.

Dear Indiana: The laws around the country vary on how to deal with sexting incidents and sharing sexual photos by cell phone. There have been a few incidents where the recipients of messages have been charged with receiving child pornography if that was the subject of the message. States are looking at their laws and how best to address this practice. It may be best to remove any photos in your phone that are obviously or even questionably sexual in nature particularly those depicting underage persons.

Judge Tom's response: It’s good that your parents agree to your move to your Dad’s home - the court that placed custody with your Mom needs to approve the change before you leave the state for Dad’s house in Texas - since they agree, it shouldn’t take long to obtain court approval and it shouldn’t be expensive either since there’s no argument over the change of residence. Your parents can talk with their lawyers if they have one, or ask the court by letter for assistance. Many courts have self-help centers to assist in this situation. Good luck and all the best.

A private swim club in the Philadelphia area, with an open membership policy, agreed to allow children from a local day-care center to swim at their pool. The Creative Steps summer camp paid the club $1950.00 for the weekly swim time.

65 children, mostly Black and Hispanic, made their first trip to the pool on June 29, 2009. Some of the kids reported hearing racist remarks about why black kids were there, and concerns about them stealing while at the pool. The Huntingdon Valley Swim Club is predominantly white and some parents reportedly pulled their children out of the pool when the campers arrived.

The Club cancelled the children’s summer membership and returned the fee. The director of the Club explained that concerns over the number of children, their safety and noise factor was the reason for revoking their membership.

The issue of drug testing at school concerns everyone on campus. While in session, your school is considered to be your temporary guardian. In that capacity, the school exercises a degree of supervision and control over you. This may include a blood or urine test to check for alcohol or drug use.
