Last Friday my 14yr old son was pulled over with two friends (the driver 1wk from turning 16) the cop called me and I went to the side of rd where they were pulled over to get him. When I walked up they had all of the boys separated and I was asked to wait in my car that they were talking to boys individually. We were (myself and two other cars with parents) there for about another hour and half while the two cops went back and forth to the boys and the parents of the boy who was the driver. I got out of my car and asked what was taking so long and the mom said they were trying to find out if they stole some things from Walmart. I saw the officer take a picture of my son and then he walked him by the arm back to me and handed me citation for a curfew violation and said call the number on the ticket to get it taken care of. That is all of the information the police gave me at all and we were getting into the car…I saw the The parent of the kid driving was asked to sign a piece of paper I assumed because her son was driving without a license and received a citation for that. I don’t know what it was exactly. When we got into the car my son told me that they did actually take some items from the store and that the officer had them write a statement and list the items they each took but did not tell them at anytime of their rights or that it could incriminate them later as a confession. The other mother said she did asked what was the verdict about the shoplifting (since the cop only spoke to them about the situation and not myself or the other parent waiting in the car) and they said it would have to be investigated further and if they decide to do anything about it someone will contact all of us. I never even gave the officer my name or any info as the guardian. The following week at school the boy driving said that he still gets to get his license and that the other boy who’s parent never got out of the car knows the sheriff. My question is now that I know the other two boys may have also gotten off on the curfew violation when my son goes to court for his ticket will the shoplifting thing be in the report or is it just a ticket. I am afraid if the other boys got the tickets cleared as a favor then my son will be the only one in question for the shoplifting also since their police reports won’t be seen by the judge at all. Can the statement my son gave be used against him in court if I was never told about the shoplifting investigation at all by the officer and I did not give my permission to have his statement or picture taken even though I was there? I would not have known about the shoplifting at all if My son hadn’t told me or asked the other mom what was said about it the next day? What should I expect in this situation. I don’t want my son to go down alone for what everyone did. If the other kids tickets were thrown out is my son the only one with a report concerning the whole incident?
