My daughter was pulled over upon being pulled over the police searched her car and possessions. They found a roach (end of a joint) in the bottom of her purse. They took her into custody where she was charged with a misdemeanor of less than a oz. they also confiscated her cell phone. After she was bonded out, they would not return her cell phone. Approximately three weeks later they called her and told her she was able to pick up her phone that everything was fine. When she went to get her phone she would not sign a paper without having a lawyer present so they put two felony charges on her. One for possession of a class II narcotic and the other was use of an electrical device in a drug transaction. She never had a class II drug on her and at this time the public defender doesn’t have anymore information than we do. What do you recommend and is it legal the way all this happened? Do we have any kind of case?
