The answers to your questions are going to depend on the specific facts and circumstances. As for your Miranda warnings being read to you, it is only required IF you are about to be interrogated or questioned while you are detained (not free to leave). If they didn’t question you, then there was no reason for them to read the Miranda warnings. As for your personal property being taken, they can do so following an arrest and while charges are pending. However, in order to conduct a search of a person’s phone for instance, they may be able to confiscate the phone but may need a warrant before searching through it. You could contact a local criminal defense attorney for further information. Many attorneys offer a free initial consultation. Good luck.
