My husband is fighting his Ex-wife to get reimbursed for Insurance premium that she has not paid her portion on for 3 years. We have asked that ORS be notified and that she pay back the amount or that it be deducted from child support going forward to make up the amount. She was served on 11/04/2016. We submitted for a decision based on her default on 11/28/2016. As she had not responded to the motion. We just learned that she filed a response on 11/29/2016 and we have not yet been served. ( we called the court for an update is how we found this out) I believe she is out of her timeframe to respond. We were told she had 14 days from the time she was served. My question is…. will the court follow through on our request for a decision or do we now have to do something else in regards to her response? Will the court accept her response?
