I have two parts to this. My wife and I own a house in Washington and I work in Idaho. Because of the commute, I stay with my parents a few nights a week. We’ve gotten into arguments and she’s told me to stay at my parents instead of coming home or she’ll call the police and have me arrested. Can she legally bar me from my own home? She often tells the police that I’m going to harm her when there is no evidence suggesting this, in order to get them to protect her and keep me out.

The second part is, due to an altercation between us from the previous year, she went to jail and her mother had me trespassed from her property. Even though her mother has invited me back numerous times since then, the no trespassing order was not lifted, to my knowledge. Now, if she doesn’t want to be around me, she’ll take the kids to her mothers and tell me that if I try to come see them, she’ll have me arrested for trespassing. Can she legally take my children someone I cannot legally go because of a no trespassing order? We have not gone to court for any custody hearings nor do we have a court ordered parenting plan. We are still married.
