Dear Anon: If this is his first offense, he may be offered a diversion program. This means that upon successful completion of community service, payment of a fine and attending a class or counseling, the charges would be dismissed and he would not have a record. He does not necessarily need an attorney to be offered diversion. You will find out more when you go to his first court date with him including the seriousness of the charges (simple possession vs. possession for sale) and the options in his case. Although he may avoid a criminal record, the incident may remain on his school record, but you would have to speak with the administration about that. Finally, if you would prefer to consult with a local attorney before his court date, you could look for one that specializes in criminal defense and possibly has experience with school law.
