Dear Anon: It totally depends on the terms of the program. Because you were arrested and now face a new charge, yes, the diversion could be terminated. However, there may be exceptions for certain offenses and you may have an opportunity to explain the circumstances. Also, since the new charge is in another state, it may not come up and even be an issue. Review the terms of diversion you probably received and signed off on when you began the program or you could ask the probation officer or whoever is supervising you. Good luck.
