Dear Anon: First, the police report(s) will concern all three boys even if charges are dismissed against one or all of them. A police report is not changed or thrown out just because charges are not filed. Ultimately, it’s up to the prosecutor’s office as to whether or not charges will be filed. Because your son was cited for curfew violation, that most likely will be the only charge filed against him when he goes to court. However, if he ends up facing additional charges for shoplifting, you may want to consult with a local criminal defense attorney to discuss the case and your son’s rights based on the laws in your state. If this is his first offense, he may be offered a diversion program and given the opportunity to avoid a record so long as he completes the program. Good luck to the both of you.
