Judge, I have a problem. I moved into my apartment at the beginning of August and my radiator was broke. The day I moved in I told the manager about it and she came to my apartment to see and she told me that she would put in a request for it to be fixed the following Monday (I moved in on a Saturday). It was in the middle of summer and it was not working so maintanence came to fix it and it still was broken. I notified the manager again and she stated that the part they needed was not in because they had to order it and that it would be fixed. It was very hot in my apartment (I live on the 18th floor). A week went by and my radiator was still broken I couldn’t deal with the heat so they had maintenance come in and rig it somehow so that the air would blow out but it was wires and no buttons so I was unable to turn it on and off. This went on for weeks and when it was too cold or hot I would have to Request for maintanence to come in and turn it on or off. They still did not have an answer as to when it would be fixed. I contacted the manager again who told me that she would talk to the guy who owned the building to see what was going on with my radiator. The guy stated that I needed a new radiator and that it would be coming in October 5th and I’m first on the list to get one. Around the middle of October it still wasn’t fixed and by this time it is not cold in Michigan (remember I moved here in August). I talked to the manager again and she said they were on back order and I should have it soon. Well now it is December and my radiator is still broken. Over the course of these weeks I have sent text messages to the manager about my radiator and she said she gave the landlord my number to give me a call. He never called me and when I would go to the office to talk to the manager, she would call him and he would tell her he would call her back after he calls the company with the radiator. Of course, he never calls back and when we call him he doesn’t answer. So now it’s December and I do not have heat (which is not living conditions and I am supposed to have heat in my apartment.). I pay my rent on time every month and I never hassle them with an attitude when I ask about my situation. So my question is, can I legally break my lease without buying out my lease or any penalty because this radiator has been broken since I moved in and they keep promising me that it will be fixed soon. No one will give me an answer so at this point I am cold in my apartment that I am paying 729 for so I’m ready to move to another place. Please I need your help! Thank you Judge!
