On 12/10/15 two police officers went to my 15-year-old daughters school and pulled her out of class to interrogated her for more than an hour without my knowledge. The two Dectives asked my daughter if she knew a boy that used to go to her high school. She explained that the boy had been messaging her on facebook, but she had never met him in person. They asked her if he admitted to her that he stole his mothers car and wrecked into a fence causing damages. She told them that he said he did a lot of things but she didn’t really believe him and thought he was somehow trying to impress her by being a “bad boy”. This boy may or may not have admitted to my daughter to participating in theft crimes. She explained that she was messaging several people at once so she wasn’t really paying attention to him. The Detectives then took my daughters phone from her and let her go back to class. I was contacted 3 hours after this interrogation and insured that Alyssa was not in trouble but was asked to give consent to seize and search her cell phone. I explained to the Detective that I felt things on her cell phone could be taken out of context and she could possibly be prosecuted, even if it has nothing to do with the underlined crime, so I chose not to sign consent. The Detective became very short with me and stated that I would not be getting her cell phone back for a few weeks because he was going to try to submit probable cause for a search warrant but would not be able to for a couple of weeks because he was the only one working in the office do to the holidays. The Detective himself stated that my daughter had absolutely no involvement with ANY crime that he was investigating so why is she being treated like a criminal and having her belongings stolen from her? It has now been almost a month and we still do not have her phone that is accruing monthly charges. I have left several messages but the Detectives never ever call me back. To this day, they have yet to file charges on the boy and yet to get a search warrant. My daughter is a good girl and has never been in trouble at school or with the law. Is this legal?
