Our tenant clogged/overflowed the toilet which then caused a leak into the neighbors garage. As a landlord my insurance denied liability for the neighbors house because we are the landlord did not cause the issue. It was confirmed that it’s not a structure problem therefor not hoa responsibility. The tenants renters insurance doesn’t want to cover because they feel it’s normal to use toilet paper and the bathroom. Plumbers came twice (happened twice in 2 weeks) and reported it was due to a lot of toilet paper. Now as a landlord we are stuck with almost a 20k bill between the 2 homes but feel we shoukdnt be responsible to pay, is there a law in California that protects landlord from issues like this. Our insurance is ho6 and tenant has ho4 if that helps. Please help I really don’t want to close out my kids savings to pay for someone else’s crap.
