My ex wife and I divorced 3 years ago. At the time I had not established myself and so I agreed to pay child support. She was listed as the managing conservator, 6 months later I took her back to court and we are now joint managing conservators. We have an equal time with the kids weekly, she has Monday, Tuesday, Wednesday and I have Thursday, Friday, Saturday, and we alternate Sundays. When we divorced her salary was never considered in determining child support, I agreed to pay what was then the house payment so that the kids could continue to live there. Now that we are equal time every week paying that full amount of child support makes it much more difficult on me. My question is based on the time we have them (weekly equal) and because her income was never considered do I have a case to request that child support be reduced or eliminated? I live in Texas. Thank you for any help you can give.
