I was in a car accident 3 yeats ago I hired a personal injury^criminal attorney. 2 years ago my son was arrested for possession of a weapon. I asked my attorney to represent my son. He fee was a flat 2 thousand dollars. I paid my attorney $600 the day I hired him, I paid the balance off in August. I don’t have receipts for the $1400. I would come in the attorney office and pay his secretary’s. Since then both secretaries quit/fired. I do have the signed contract stating I paid $600,;leaving a $1400 balance. The day my son had court the attorney did not show up, the case was adjourned. My son next court the attorney did not show up. The attorney sent Mr. Louis who works for a service called Legal aid. Mr. Louis told me he was my attorney partner. Mr. Louis advised my son to plead quilty, Mr. Louis said my son would get probation, because he has never been in trouble. I phoned the attorney, he was in court on another case. Mr. Louis said if my son go to trial he may get 5 year’s, so plead and get probation. I had to leave my son, and report to work. I read my son plea, and noticed it did not say probation. I immediately called the attorney. My attorney told me I would have to pay him $3500 from my settlement in order to get my son probation. I agreed and signed. The attorney missed 5 of my son court dates (adjourned ) My son had a court date on the 29th of September. I called the attorney office to confirm the attorney will be there and was told he would not. I then called the court to confirm, and was told the attorney did not reschedule. I called the attorney office again, explained to her the court has no record of the attorney cancelling, and she needs to call the court. The attorney secretary phoned me and said the attorney quit. (UNBELIEVABLE) attorney office faxed over letter to reschedule. The time was 9:30am. I informed the court clerk attorney said he quit. The judge sent the attorney a letter sating he was still the attorney, and must report to court Oct 7.Later that day I spoke with my attorney. I expressed to him my concerns regarding probation and the legal aid making a plea deal for my son and lying. The attorney told me he quit. My son expressed to him Mr. Louis lied to him. Oct 7 I called the attorney office to confirm he would be in court. The secretary said no, and my son doesn’t have to go (adjourned) Remember this has happened several times. My son dad is sheriff at the Hudson County court. He was informed that my son had a warrant for failure to appear. Judge, the attorney was not in court on the 7th. He gets a slap on the wrist. My son was rearressted. My son appeared in court a week later in cuffs. He told the Judge why he didn’t show, the attorney claims I never called his office, I have phone records proving him wrong. My son asked the judge of he could take back his plea, because Mr. Louis lied to him. The attorney chimed in and said Mr. Louis did not say that. How does he know what was said, he was not there. Isn’t that “hear say”. My son said on record he does not want his attorney to represent him any longer. When my son said he wanted to take his plea back, the attorney said ” he quit” on record. I spoke with the public defender office, they could not review my son case, until his attorney motion to be removed. Nov 15th my court date, the attorney kept us waiting for an hour. He asked the court clerk, where was my son new attorney. The clerk responded “you did file a motion “. It was a joke to him. Please feel my pain.
