I have been separated for nearly 7 years my ex partner still lives in the maritial home with my 2 children aged 20 and 11 years old with her new partner .
I live with my partner of 6 years in another address and have amicable access to my children .
I have been paying my ex partner an agreed sum of monies per month since we separated this is all fine .
My problem lies with the fact I am in a joint mortgage with my ex wife and wanted to transfer the deeds over for nil consideration ( basically walk away and leave her with the house ) she applied to our lender to have mortgage transferred in her name only BUT they have since decided to refuse it to happen under the grounds of that she doesn’t earn enough/ work enough hours and is seen as a risk basically .
I am now left in limbo and do not know what to do , I do not want or wish any hardship on my ex wife but failure to transfer it into her own name means I cannot proceed for a divorce under Scottish law it seems and desperately looking for an answer or solution to this problem .
Can you please help as I am at my wits end and my current partner is really hurt / angry and upset that I am still basically and legally married as WE all just want to move on with our lives . I have spent thousands of wasted pounds over the last 6 years and get the feeling basically my lawyers are just not interested in helping me but for the money I give them it is me who has to get updates from them etc its terrible , I hope you can give me some sort of solution whether it be a written signed agreement between 2 lawyers or something please help .
