I have custody of my daughter for the past 8 years. We live in Louisiana. The mother has been developing her own judgment of the court papers. In other words, it states in the court documents that she gets her every other weekend starting after school on Friday and returning at 5pm on Sundays. She has on several occasions picked her up from School and not from the meeting point at 5pm. On Sundays has not returned her till 6pm for the past 8 years. When I try to tell her that she is violating the order it creates a Huge Argument because she is dictating the order instead of following what was written on paper.
This years is a even year, meaning her mom gets her for Christmas. The order states that she is to pick her up the day after school lets out at 9am and return her the day after Christmas at 5pm. The child’s birthday falls on Christmas day, which the order states that we get equal time with the Child on her birthday.
I was allowing her mom to pick her up the day she let out of school till Christmas day at 5pm. Her mom has threatened me stating that HER court papers state that she is allowed to pick up the child from school the day it lets out and return her the day after Christmas at 5pm. I told her that she can either go with the school pick up, giving her a day ahead of the order, and drop her Christmas day at 5pm so I can have her for the rest of the time for her birthday. She has told me that she is doing it her way.
My question is if she violates the order and picks her up at school a day before the order states, can I call the police and have her arrested for violating the order?
