Hello Judge,
I’m 40 years old from utah. I’m paraplegic for the past 5 years I have been due to an auto accident. Recently a friend of mine left me at at store he drove us to. After leaving me he was arrested for dui, prescription drug possession, paraphernalia possession. My phone was in his vehicle. My phone was taken as evidence. My friend gave me the officers number to call about my phone. When talking with the officer over the phone he indicated to me he had reason to believe the texts received on my phone were drug related and he’s holding it as evidence. I briefly explained the texts that he explained texts he read on my phone and I gave him reasonably explanation as to how I had no shock in the texts he continues holding it as evidence one week later. He has disrupted my Life judge. He continues holding my phone. How long until he can no longerhold it lawfully?
