My boyfriend and his x girlfriend have a child, she refuses to let him see this child but there is no custody order what so ever. If he picks him up from. Daycare and just lets her know he picked him up, and nathens gonna spend the night with him at his house…can he be in trouble for kidnapping? Reno is 45min from where he lives in doyle cali. Would crossing the border make a difference in him taking his son? Is it considered obduction?

I told him he should file for custody first then pick him up, is this his best option? is it true whoever files first gets to keep the child with them until court?

I just want to make sure all is done the correct way so he does not get in trouble!
