My daughter was a passenger in a car, took a breathalyzer test and was issued a citation. She plead not guilty on first visit to court. Now, (second visit) does she talk to a mediator before the judge or go in front of judge to enter plea? What are the options to enter a diversion program? Can she plead no contest or must plead guilty in order to enter diversion program? Assuming its a guilt only plea, does she state “I will plead guilty conditional of diversion program” or she doesn’t have freedom to state conditional clause? We are in the state of Arizona.
