Filed complaint with EEOC after getting right to sue. Hired an attorney. Statue of limitations was missed by my attorney to file a wrongful termination based on the employer not honoring a disability request (12-year employment history – ended in Feb 2014). Attorney committed malpractice and had has license pulled, he stopped his malpractice insurance while working on my case (Oct 2016). My case had to be filed by Feb 2017. There was an appeal filed with the employer from Feb 2014 to May 2014 – which was denied. What laws allow me to have my case heard (given the attorney’s licenses was pulled during working on my case and he did not file it). Are there laws to protect individuals from this type of malpractice? Very concerned that the laws aren’t set up to protect individuals from what I’ve addressed – but I am hopeful there is something that can be done to correct the situation. Live in MA
